Discipline and Fitness to Practise Hearings

When concerns are brought to the College’s attention they are reviewed by a group of individuals who are members of the Inquiries, Complaints and Reports Committee (ICRC). The members include physiotherapists/physical therapists and members of the public who have been chosen by the government to represent the public. There are no staff members on the Committee.

The members of the Committee review the concerns, the physiotherapist’s response and all of the other information that has been provided to them or obtained for them. At the end of their review they can make a number of different decisions. Each year approximately 2 to 4 per cent of the cases are referred to either the Discipline Committee or Fitness to Practise Committee for a hearing.

Discipline Hearing

The members of the Committee (ICRC) can refer a physiotherapist to the Discipline Committee for a hearing if they believe that he or she is incompetent or that he or she has committed an act(s) of professional misconduct and that no other decision would be reasonable in the public interest. These hearings are open to the public and the decisions are made available to the public on the Public Register at the conclusion of the hearing. The Public Register is an online directory of physiotherapists who practice in the province.

Decisions of the Discipline Committee

In accordance with section 56(1) of the Health Professions Procedural Code, Schedule 2 of the Regulated Health Professions Act, the College is required to make certain information available to the public at the conclusion of a hearing.

Fitness to Practise Hearing

The members of the Committee (ICRC) can refer a physiotherapist to the Fitness to Practise Committee for a hearing if they believe that he or she is suffering from a health condition or disorder that is affecting their ability to practice safely and effectively and that no other decision would be reasonable in the public interest. Because of the nature of the issues involved in these cases, these hearings are closed to the public however a summary of the decisions are available to the public on the Public Register at the conclusion of the hearing.

Decisions of the Fitness to Practise Committee

In accordance with section 23(2)7 of the Health Professions Procedural Code, Schedule 2 of the Regulated Health Professions Act, the College is required to publish the results including a summary of the decision of every incapacity proceeding where a finding has been made.
