Under the Regulated Health Professions Act of Ontario (RHPA) each regulated health profession’s College is required to establish a program to provide funding for therapy and counselling for patients who were sexually abused by registrants of that College. The Patient Relations Committee determines eligibility and administers the fund.

The following information is intended for people considering applying for funding from the College of Physiotherapists of Ontario.

Who is eligible?

A person is eligible for funding when a College discipline panel makes a finding that the person, while a patient, was abused by the accused physiotherapist.

If there is not a finding by a discipline panel, a person may be eligible under other criteria established by the College in the General Regulation: Part II – Funding for Therapy and Counselling. These criteria include:

A written admission by a physiotherapist to the College that he or she sexually abused the person while the person was a patient, 

or

Sufficient evidence presented to the College to support the belief that the person was sexually abused and the physiotherapist has died or cannot be located, 

or

Where a physiotherapist has been found guilty of sexually assaulting the person under the Criminal Code of Canada.

How much funding is available?

The maximum funding available to each applicant is established by the RHPA and is equivalent to the amount that the Ontario Health Insurance Plan (OHIP) would pay for 200 half-hour sessions of individual out-patient psychotherapy with a psychiatrist. This funding amounts to approximately $16,000 per person and is accessible over a five-year period. Under the RHPA, applicants are required to use other available sources of funding, such as private insurance, first.

Choice of Counsellor/Therapist

Applicants are free to choose any therapist or counsellor to provide treatment as long as the therapist or counsellor is not a relative and has not been found guilty of sexual abuse. However, if the therapist or counsellor is not a member of a regulated health profession, they are not subject to professional discipline by the College of Physiotherapists of Ontario or by any other health regulatory body.

Applicants can access the fund for more than one therapist or counsellor if they so choose.

Funds are paid directly to the chosen therapist or counsellor for treatment provided.
