What steps can a physiotherapist take to make sure they comply with the Personal Health Information Act (PHIPA)?

Answer:

The Personal Health Information Act (PHIPA) is a provincial law that governs how healthcare providers collect, use and manage personal health information.

As outlined in PHIPA, Health Information Custodians (HICs) have a duty to protect personal health information against privacy breaches. This includes implementing privacy policies to help protect patient information. HICs can be institutions, facilities or private health practitioners that deliver healthcare services. If you are an agent of the HIC, you must follow the privacy policies developed by the HIC and report any privacy breaches as soon as possible.

Here are some steps you should take to make sure you are following all privacy requirements:

  • Keep patient information private. Don’t share information with others unless you have the patient’s consent, or you are sharing the information with another healthcare provider within the patient’s circle of care.
  • Only access patient information when necessary for the patient’s treatment.
  • Don’t talk about a patient’s private health details in public.
  • Don't share computer passwords with anyone.
  • Use secure methods, like encrypted emails, to send health information electronically.
  • Keep devices with patient information safe by logging out when you’re not using them.
  • Report any privacy breaches directly to the designated HIC. This includes when information is lost or accessed by unauthorized people.
  • Stay up to date on rules and procedures for handling patient information.
