Acknowledgement and Undertaking as Signed by Mark Edwards (Registration #12383) on October 7, 2021

 

I, Mark Edwards (Registration #12383), hereby acknowledge and undertake as follows:

  1. I acknowledge that allegations relating to my practice and/or conduct are being investigated by the College as Case File No. 2020-157.
  2. Specifically, I acknowledge that the allegations about my practice in College Case File No. 2020-157 in relation to: (1) professional boundaries; (2) unprofessional behaviour; (3) making remarks towards a patient that are sexual in nature; and (4) record keeping have been raised before the Inquiries, Complaints and Reports Committee (ICRC) of the College of Physiotherapists of Ontario (the “College”).
  3. I acknowledge and agree that, in exchange for my providing to the College an original copy of this Undertaking executed by me, the College agrees not to proceed with further investigation into my conduct.
  4. Unrelated to this matter I resigned my certificate of registration with the College effective March 31, 2021.
  5. I hereby undertake to never apply or re-apply for membership, registration, licensure, or similar status with the College as a physiotherapist or for a license to practice physiotherapy in Ontario or in any other jurisdiction after the effective date.
  6. I acknowledge that if I ever apply or re-apply, or attempt to apply or re-apply for membership, registration, licensure, or similar status with the College in the future, the College will be entitled to rely upon this undertaking and details of the investigation in any registration or other similar proceeding as reason to deny my application.
  7. I acknowledge that if I ever apply or re-apply for membership, registration, licensure, or similar status as a physiotherapist for a license to practice physiotherapy in Ontario after March 31, 2021 the College shall, in its sole discretion, have the right to proceed with a disciplinary proceeding on the basis of a breach of this undertaking and, if I am successful in being registered, the College shall also be entitled to proceed with the investigation of my practice based on the complaint made against me in Case File No. 2020-157.
  8. I acknowledge that after I resign my certificate of registration with the College, I will not be entitled to use the title “physiotherapist”, “physical therapist” or any abbreviation thereof (such as “PT”) or equivalent in another language. I will not be entitled to hold myself out as a person who is qualified to practice in Ontario as a physiotherapist/physical therapist and I will not be entitled to imply that I am a physiotherapist/physical therapist in Ontario.
  9. I acknowledge that the College is required under Section 23 of the Health Professions Procedural Code which is Schedule 2 of the Regulated Health Professions Act to publish this Undertaking on the public register.

  10. I hereby agree to bear the risk of any prejudice that the passage of time might cause to my ability to provide a full answer and defense and I waive the right to seek any remedy on the basis of the passage of time, should the College proceed with the investigation in Case File No. 2020-157 and any allegations that may arise as a result of any future breach of this Undertaking by me.
  11. I acknowledge that this Undertaking will form part of my history with the College and may be referred to in any future investigation, proceeding or hearing that I may be subject to.
  12. I acknowledge that I have been advised of my right to obtain legal advice prior to entering this Undertaking and have either availed myself of that right or chosen not to avail myself of that right.
  13. I have been advised that my agreement to this Undertaking would be in addition to the requirement that I attend before a panel of the Inquiries, Complaints and Reports Committee to receive a caution at a date and time to be set by the Registrar.
